U.S. Court Finds EPA Erred In Approving Dow Insecticide

Yahoo News and Reuters are reporting that a U.S. appeals court ruled on Thursday that federal EPA regulators erred in allowing an insecticide developed by Dow AgroSciences onto the market, canceling the chemical’s approval and giving environmentalists a major victory.

The ruling was handed down in a lawsuit filed in 2013 by beekeeping organizations against EPA, specifically challenging the agency’s approval process for insecticide products containing the active ingredient sulfoxaflor, which Dow AgroSciences had marketed under the brand names Transform and Closer. The plaintiffs claimed EPA glossed over several studies with results showing a negative impact on pollinator health.

“Dow AgroSciences respectfully disagrees with the Ninth Circuit’s conclusion that EPA’s registration of products containing sulfoxaflor should be vacated. Dow AgroSciences will work with EPA to implement the order and to promptly complete additional regulatory work to support the registration of the products. Dow AgroSciences is also considering its available options to challenge the Court’s decision.”
