DHS Seeks AN Security Comments

The Agricultural Retailers Association (ARA) is asking its members to comment on the proposed Secure Handling of Ammonium Nitrate (AN) Program.

The U.S. Department of Homeland Security (DHS) issued an Advanced Notice of Proposed Rulemaking (ANPR) for the Secure Handling of Ammonium Nitrate (AN) Program in the Oct. 29 Federal Register .This ANPR seeks industry comments on a new DHS program, which requires the agency to regulate the sale and transfer of AN by a facility to prevent the misappropriation or use of this product in an act of terrorism.

ARA worked with The Fertilizer Institute (TFI) in support of enactment of this DHS program “because it will help to further secure AN and keep it available to America’s agricultural industry,” according to an ARA press release.

DHS is seeking written data, views, or arguments on all aspects of this proposed program, especially as it relates to economic, environmental, or federalism effects that may result from any final rule. The comments will help DHS in the development of procedures for this ammonium nitrate registration program.

The DHS questions are posted on the Federal Register or on ARA’s Web site. ARA requests its members e-mail comments on those questions to Richard Gupton, ARA vice president of legislative policy & counsel, at [email protected]. ARA plans to submit a comment letter on this new AN registration program and needs input from ARA members.”

Written comments must be submitted to ARA by Nov. 26.
