Court Rejects EPA Objection To Enlist Duo

It was pretty big news last fall when, just before Thanksgiving, the EPA attempted to withdraw its approval of Dow AgroSciences’ Enlist Duo for use in 2016 “based upon new data received by the agency.” At the time, the company released multiple statements to the media saying it was confident Enlist Duo and the Enlist cropping system to combat herbicide-resistant weeds would still be available for corn growers for the 2016 season.

And this will indeed be the case. Last week, the U.S. Ninth Circuit Court of Appeals rejected EPA’s attempt to pull Enlist Duo’s label registration. As a result, Dow AgroSciences will continue to be able to market the product for labeled uses across the 15 states it is approved for. This includes Illinois, Iowa, Indiana, Ohio, Missouri, and Nebraska. In the meantime, the company will “continue to work cooperatively with the U.S. EPA concerning Enlist Duo,” it said in a released statement.

For growers across the Midwest and Mid-South struggling to keep yields up while combating a host of herbicide-resistant weeds, this is great news. Enlist Duo herbicide is a blend of glyphosate and 2,4-D choline and has been shown in field trials the past few seasons to act as an additional tool to control such difficult-to-manage weeds as ragweed and waterhemp.

In addition to Enlist for corn, Dow AgroSciences is also working on varieties for both soybeans and cotton. These should be approved for market use within the next few years, says the company.
